These Terms of Service (“Terms”) apply when you use BayBoard, including the website at bayboardapp.com and the application at app.bayboardapp.com (together, the “Service”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a business, you confirm you can agree to these Terms for that business.
1. The Service
BayBoard provides job-board and shop-management software for repair shops, including job tracking, time tracking, work orders, customer intake forms and reports. The Service is currently in early access. Features may change, be added or be removed, and parts of the Service may be unavailable from time to time.
2. Your account
- You must provide accurate information when you register and keep it up to date.
- You are responsible for keeping your password confidential and for everything that happens under your account, including actions by staff you add.
- Tell us promptly if you believe your account has been accessed without permission.
- Each person should use their own login. Accounts must not be shared.
3. Your shop’s data
You keep ownership of the information you and your staff put into BayBoard, including your customers’ details, jobs, notes, photos and signatures (“Your Data”). You give us permission to store and process Your Data only to provide and improve the Service. You are responsible for having the right to enter Your Data, for the accuracy of what you enter, and for following the privacy, consumer and record-keeping laws that apply to your shop, including any customer consent you need before collecting signatures or contact details.
4. Acceptable use
You agree not to: break the law using the Service; attempt to access another shop’s data; probe, scan or disrupt the Service or its security; upload malicious code; send spam; use the Service to store content you do not have the right to store; or resell the Service without our written permission. We may suspend accounts that put the Service or other users at risk.
5. Demo shops
The live demo creates a temporary sample shop. Demo shops contain fake data, are not intended for real customer information, and are deleted automatically after about 24 hours.
6. Fees
BayBoard is free during early access. If we introduce paid plans, we will tell you in advance and you will be able to choose whether to continue. We will not charge you without your agreement.
7. Availability and backups
We work to keep the Service running and your data safe, but we do not promise uninterrupted or error-free operation. We recommend you keep your own copies of information that is critical to your business, for example by using the CSV export in reports and by keeping printed or PDF work orders.
8. Ending your use
You can stop using the Service at any time. You can ask us to close your account and delete Your Data by contacting us (see below). We may suspend or end access if you break these Terms, if your account is inactive for a long period, or if we stop providing the Service; where reasonable we will give you notice and a chance to export Your Data first.
9. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent allowed by law we disclaim all warranties, express or implied, including fitness for a particular purpose. BayBoard is a business tool: it does not provide legal, tax or accounting advice, and sample wording in the Service (such as the work-authorization text) is general information that you should review for your own location and business.
10. Limitation of liability
To the fullest extent allowed by law, BayBoard and its owners will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim (which is zero while the Service is free).
11. Changes to these Terms
We may update these Terms from time to time. If we make a material change we will post the new version here and update the date above. Continuing to use the Service after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada that apply there. Courts in Ontario will have jurisdiction over disputes, unless the law where you live gives you the right to bring a claim elsewhere.
